{"id":5256,"date":"2026-05-21T11:05:16","date_gmt":"2026-05-21T09:05:16","guid":{"rendered":"https:\/\/www.crccdlex.com\/?p=5256"},"modified":"2026-05-21T11:06:46","modified_gmt":"2026-05-21T09:06:46","slug":"newsletter-may-2026-pt-1-restructuring-and-insolvency-proceedings","status":"publish","type":"post","link":"https:\/\/www.crccdlex.com\/en\/newsletter-may-2026-pt-1-restructuring-and-insolvency-proceedings\/","title":{"rendered":"Newsletter May 2026 (pt. 1): Restructuring and Insolvency proceedings"},"content":{"rendered":"<h4>EBA: amendments to the guidelines on the definition of default<\/h4>\n<p>On 7 May 2026, the European Banking Authority (\u201c<strong>EBA<\/strong>\u201d) published the <a href=\"https:\/\/www.eba.europa.eu\/sites\/default\/files\/2026-05\/35b162ff-9373-4fdb-87f2-7b775e1c2cfd\/Amending%20Guidelines%20on%20definition%20of%20default.pdf\">final report<\/a> amending the guidelines on the application of the definition of default, developed in implementation of Article 178 of Regulation (EU) 2013\/575 (the \u201c<strong>CRR<\/strong>\u201d), as amended by Regulation (EU) 2024\/1623 (\u201c<strong>CRR 3<\/strong>\u201d), which mandates the EBA to review and update the Guidelines.<\/p>\n<p>In particular, the principal amendments introduced concern the following aspects:<\/p>\n<ul>\n<li>with regard to non-recourse factoring, the reference period for the technical past-due treatment at the of individual invoice level has been extended from 30 to 90 days, with a view to better reflecting the operational features of invoice-based receivables and reducing the risk of incorrect default classification; and<\/li>\n<li>the guidelines have been aligned with the amendments introduced by CRR 3; and<\/li>\n<li>the adequacy of the 1% threshold applied to reductions in net present value (the so-called \u201c<strong>NPV threshold<\/strong>\u201d) has been confirmed as sufficiently flexible, risk-sensitive and consistent with the accounting framework, as well as aligned with the other thresholds used for the identification of default.
