{"id":6096,"date":"2026-11-05T14:54:06","date_gmt":"2026-11-05T13:54:06","guid":{"rendered":"https:\/\/www.crccdlex.com\/?p=6096"},"modified":"2026-11-05T14:54:06","modified_gmt":"2026-11-05T13:54:06","slug":"newsletter-october-2026-pt-2-restructuring-and-insolvency-proceedings","status":"publish","type":"post","link":"https:\/\/www.crccdlex.com\/en\/newsletter-october-2026-pt-2-restructuring-and-insolvency-proceedings\/","title":{"rendered":"Newsletter October 2026 (pt. 2): Restructuring and Insolvency Proceedings"},"content":{"rendered":"<h4>Italian Tax Authority: Circular No. 9\/E on over-indebtedness and debt discharge published<\/h4>\n<p>On 21 October 2026, the Italian Tax Authority (<em>Agenzia delle Entrate<\/em>) published <a href=\"https:\/\/www.agenziaentrate.gov.it\/portale\/documents\/20143\/10360006\/Circolare+n.+9+del+21+ottobre+2026.pdf\/cfb98eb0-25b4-fc17-1e5f-88cd651d4a3b?t=1792579278499\">Circular No. 9\/E<\/a> (the \u201c<strong>Circular<\/strong>\u201d), the second part of the framework of the institutions of the Code of Business Crisis and Insolvency under Legislative Decree No. 14\/2019 (the \u201c<strong>Code<\/strong>\u201d), dedicated to the procedures for the settlement of over-indebtedness crises and to debt discharge (<em>esdebitazione<\/em>).<\/p>\n<p>The aim is to provide a clear and coherent picture of the rules in force, which will foster uniform application of the procedures and a proper balance between the protection of the debtor and the effective satisfaction of creditors. Accordingly, with the Circular, the Italian Tax Authority provides operational instructions to its Offices in order to ensure uniformity of action.<\/p>\n<p>In particular, the Circular examines the instruments for the regulation of over-indebtedness crises governed by the Code, with specific reference to the restructuring of consumer debts, family base procedures, the minor composition with creditors (<em>concordato minore<\/em>) and controlled liquidation (<em>liquidazione controllata<\/em>).
